These Terms & Conditions (the "Terms") govern (a) the use of the website mallorcaspaliving.com, and (b) the sale and installation of whirlpools, jacuzzis, spas and related services supplied by Mallorca Spa Living ("we", "us", "our"). Please read carefully before using the Site or placing an order.

1. Acceptance of the Terms

By using the Site or by accepting a written quote we have prepared for you, you confirm that you have read, understood and accepted these Terms. If you do not agree, please do not use the Site or our services.

2. Information on the Site

All information on the Site — specifications, prices, installation options, lead times, photographs — is provided in good faith and for orientation purposes. It may be updated without prior notice. The Site is not an online shop. A binding contract is formed only once we have issued and you have accepted a written quote.

3. Price calculator

The price calculator on the Site provides an indicative estimate based on the configuration you enter. The estimate:

• Is not a binding offer.
• Does not constitute a contract.
• Is subject to a site inspection and a final written quote.
• Includes 21% Spanish VAT (IVA) unless explicitly stated otherwise.

4. Quotes and orders

1. You request a quote via the contact form, the calculator, WhatsApp, email, phone, or in person at our showroom.
2. We may carry out a site inspection and propose installation details.
3. We issue a written quote (presupuesto) detailing scope, products, price, payment terms, and lead times.
4. The contract is formed when you accept the quote in writing and pay the agreed deposit.
5. Once the contract is in place, scope changes may affect price and lead times and must be agreed in writing.

5. Prices, payment, and invoicing

• Prices are in euros (EUR) and, unless stated otherwise, include 21% Spanish VAT (IVA).
• Standard payment terms: [X]% deposit on order, [Y]% before delivery, balance on completion — exact terms appear on each quote.
• Accepted methods: bank transfer (preferred). Card or cash may be available subject to agreement.
• An invoice (factura) is issued in accordance with Spanish tax law.

6. Delivery and installation

• Delivery and installation areas: Mallorca. Off-island deliveries are possible by agreement.
• Lead times shown on the Site or in quotes are estimates, not guarantees, and may be affected by supplier production, transport, or site conditions.
• Access to the installation site must be safe and suitable. The Customer is responsible for ensuring access, permits where required, and a prepared installation surface unless we have explicitly agreed to handle these works.
• Foundation, terrace works, electrical and plumbing connections may be included in the quote where agreed.

7. Warranties

• Product warranty: manufacturer warranty applies and is transferred to the Customer. Length and conditions depend on the model and appear on the quote.
• Installation warranty: we provide a [2-year] warranty on our installation workmanship.
• Legal conformity guarantee: consumer purchases are also covered by the conformity guarantee under Spanish Royal Legislative Decree 1/2007.
• Warranties do not cover damage caused by misuse, accidents, unauthorised modifications, or failure to follow maintenance instructions.

8. Right of withdrawal (consumers)

Where applicable, consumers have a 14-day right of withdrawal for off-premises contracts under the Spanish Consumer Protection Act. This right does not apply to goods made to consumer specifications or clearly personalised, nor to installation services already performed with prior express consent.

9. Liability

Our liability is limited to direct damages reasonably foreseeable as a consequence of a breach of these Terms or the contract. We do not exclude liability where Spanish law does not allow exclusion.

10. Force majeure

Neither party is liable for failure or delay in performance caused by events outside reasonable control, including natural disasters, strikes, transport disruptions, supplier failures, government actions or public health emergencies.

11. Personal data

Processing of personal data is governed by our Privacy Policy.

12. Changes to these Terms

We may update these Terms from time to time. The version applicable to a given contract is the one in force on the date the quote is accepted.

13. Applicable law and dispute resolution

These Terms and any contract derived from them are governed by Spanish law. For consumer disputes we adhere to the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.

The parties submit any dispute to the Courts of [PALMA DE MALLORCA], without prejudice to the consumer's rights.
